The Village of Capitan Board of Trustees held their regular meeting on October 11, 2005 at the Village Hall Meeting Room. Mayor Steve Sederwall called the meeting to order at 6:40 pm following the public hearing. Trustees present were George Tippin, Bobbi Shearer, and Ed Davis. Trustee Martin was not present.

Motion by Trustee Shearer seconded by Trustee Davis to accept the agenda as amended, pulling the accounts payable from the consent agenda and adding budget as item #18 to the agenda. All favor, motion carried.

Consent Agenda Motion by Trustee Shearer seconded by +rustee Tippin to approve the consent agenda. Roll Call: Trustee Tippin yes, Trustee Davis yes, Trustee Shearer yes.
Motion by Trustee Shearer seconded by Trustee Davis to approve the accounts payable as amended, correct the Lodgers Tax Fund check # 1004 in the amount of $600. Roll Call: Trustee Tippin yes, Trustee Davis yes, Trustee Shearer yes.

Repeal 2002 Code, Title 1, Chapter 7, Section 3.13: Dress and Appearance in its entirety Motion by Trustee Shearer seconded by Trustee Davis to approve Ordinance 2005-17. Roll Call: Trustee Tippin yes, Trustee Davis yes, Trustee Shearer yes.

Delete 2002 Code, Titlc 1, Chapter 7, Section 10.11: Standby in its entirety Motion by Trustee Tippin seconded by Trustee Shearer to approve Ordinance 2005-18. Roll Call: Trustee Tippin yes, Trustee Davis yes, Trustee Shearer yes.

Changes to Title 1, Chapter 7, Section 3.13; Dress and Appearance recommendation #2 Motion by Trustee Shearer seconded by Trustee Davis to accept recommendation #2 for Dress and Appearance. Roll Call: Trustee Tippin yes, Trustee Davis yes, Trustee Shearer yes.

Library presentation The library representatives gave a presentation to the council on the possibility of leasing the gas building. The council thanked them for the presentation and asked that they give a presentation to the Town of Carrizozo or the Capitan Carrizozo Natural Gas Company, since both the Town of Carrizozo and Village of Capitan has an interest in the building.

Ed Tinsley ETZ Water Presentation was given by Ed Tinsley for ETZ water. Motion by Trustee Shearer seconded by Trustee Davis to accept the agreement for the provision of water in exchange for water rights with changes in #3 and #4 that will be reviewed by the attorneys. Roll Call: Trustee Tippin no, Trustee Davis yes, Trustee Shearer yes.

Domestic Violence Cindy with the Domestic Violence Program made a presentation and a proclamation was signed by the Council in support of the program.
Smokey Bear Museum/Gift Shop Operation Procedures Motion by Trustee Tippin seconded by Trustee Davis to approve the Operation Procedures for the Smokey Bear Museum. Roll Call: Trustee Tippin yes, Trustee Davis yes, Trustee Shearer yes.

Smokey Bear Days Village Sponsorship and Resolution 2005-3 5 Trustee Tippin ask the board to consider the Village sponsoring the Smokey Bear Days and have a coordinator for the event. Motion by Trustee Tippin seconded by Trustee Shearer to accept Resolution 2005-3 5 concerning the sponsorship of Smokey Bear Days. Roll Call: Trustee Tippin yes, Trustee Davis yes, Trustee Shearer yes.

Motion by Trustee Tippin seconded by Trustee Davis to approve the Eddie Tudor for the coordinator for the Smokey Bear Days. Roll Call: Trustee Tippin yes, Trustee Davis yes, Trustee Shearer yes.

Old Fire Station environmental assessment Motion by Trustee Tippin seconded by Trustee Shearer to include an environmental assessment for the old fire station in the Community Center $50,000 RFP. Roll Call: Trustee Tippin yes, Trustee Davis yes, Trustee Shearer yes.

Planning Board Patricia Doyal; Hitchin Post Plat approval 320 Smokey Bear Motion by
Trustee Tippin seconded by Trustee Shearer to approve the Hitchin Post replat. Roll Call: Trustee Tippin yes, Trustee Davis yes, Trustee Shearer yes.
Planning Board Replat Resolution Proposal The board was going to ask the attorney about the progress of the proposed replat, the attorney was not present.

Resolution 2005-34 Lincoln County Solid Waste Authority Motion by Trustee Tippin seconded by Trustee Shearer to approve Resolution 2005-34. Roll Call: Trustee Tippin yes, Trustee Davis yes, Trustee Shearer yes.

Recommendation for Johnathon LaMay Motion by Trustee Davis seconded by Trustee Shearer to raise Johnathon LaMay to $15.00/hour effective this pay period. Roll Call: Trustee Tippin yes, Trustee Davis yes, Trustee Shearer yes.

Budget Motion by Trustee Tippin seconded by Trustee Davis to approve memo to transfer money between employee benefits fin/admin to travel & training judicial in the general fund. Roll Call: Trustee Tippin yes, Trustee Davis yes, Trustee Shearer yes.

Motion by Trustee Tippin seconded by Trustee Davis to transfer money from employee benefits public safety to public safety special ops in the general fund. Roll Call: Trustee Tippin yes, Trustee Davis yes, Trustee Shearer yes.

Adjournment Motion by Trustee Davis seconded by Trustee Shearer to adjournment at 8:00 pm. All in favor, motion carried.
