Friday, November 4, 2005

Village Hall
The Village of Capitan Board of Trustees held a special meeting at
Village Hall, Capitan, New Mexico on November 4, 2005. The meeting was
called to order by Mayor Sederwall at 7:00 pm. Present at the meeting
were Trustee Martin, Trustee Davis, and Trustee Tippin. Trustee Shearer
was absent.
Executive Session 10-15-1 ( 7 Threatened/Pending Litigation Police
Department Village Attorney Marc Prelo was not present at the meeting;
therefore the Governing Body was unable to go into executive session.
Professional Services based on Threatened/Pending Litigation Police
Department
Motion by Trustee Martin that the Village of Capitan enter into a
Professional Services Agreement with Gary Mitchell, Attorney at Law,
for the express purpose of representing, and if necessary, defending,
on behalf of the Village, Chief Robert Bird and Officer Randy Haskins,
employees of the Village, in the upcoming Grand Jury hearing, and any
subsequent criminal proceedings, as brought forth by the District
Attorney, for a sum not to exceed five thousand dollars ($5,000.00).
Second by Trustee Tippin. Roll call: Trustee Martin — yes, Trustee
Tippin — yes, Trustee Davis — yes. Motion carried.
Motion by Trustee Tippin, seconded by Trustee Davis, to adjourn at 7:08
pm. All in favor, motion carried.
