Regular Council Meeting
July 9 2002
7:00 p.m.

Meeting was called to order by Mayor Sederwall at 7:00 p.m. Roll Call: Leroy Montes, here, George Tippin, here, Bobbi Shearer, here, John Whitaker, here. Also present were Village Attorney, Don Dutton and Deputy Clerk, Amanda Vega.

Motion was made by Trustee Tippin to approve agenda with the exception of removing Valor Franchise until the next regular meeting. Motion seconded by Trustee Whitaker, all in favor, motion carried.

Motion by Trustee Tippin to approve minutes from June 11th meeting, with the correction on the bottom of page four, which should be changed from "one time merit pay raise" to "services beyond the scope of the contract." Motion seconded by Trustee Whitaker. All in favor, motion carried.

Motion by Trustee Shearer to approve minutes from July 2 seconded by Trustee Tippin. All in favor, motion carried.

Motion by Trustee Shearer to approve Accounts Payable with the addition of June's Solid Waste bill. Motion seconded by Trustee Whitaker. All in favor, motion carried.

Executive Insurance: Attorney Don Dutton gave a presentation on the legal aspects of providing a trustee with health insurance. Mr. Dutton feels that the Village should not provide this compensation to a trustee as it violates the ordinance which dictates the compensation for trustees and mayor.

Motion was made by Trustee Tippin to approve tile Budget Resolution2002-11with the exception of deleting item 6002, which is Executive insurance premiums. Trustee Whitaker seconded the motion. Roll call: Trustee Tippin, yes, Trustee Whitaker, yes, Trustee Montes, no, Trustee Shearer, yes. Motion carried.

Motion to table Resolution 2002-12 (which is to borrow money for the Dodge Durango Police Vehicle so that the Police Department will have money to purchase other necessary items,) until we have more information. Motion seconded by Trustee Shearer. Roll Call: Trustee Tippin, yes, Trustee Whitaker, yes, Trustee Shearer, yes, Trustee Montes, yes. All in favor, motion carried.

Motion to approve the fire department officers as presented by Fire Chief, David Cox by Trustee Tippin. Motion seconded by Trustee Montes. Roll call: Trustee Shearer, yes, Trustee Tippin, yes, Trustee Montes, yes, Trustee Whitaker, yes.

There was discussion, but no action on the possibility of having two meetings per month.

Motion was made by Trustee Montes to advertise for sealed bids for gravel and fuel. Motion seconded by Trustee Whitaker. All in favor, motion carried.

Motion was made to table discussion on LCSWA, pending further legal review by Mr. Bell by Trustee Shearer, motion seconded by Trustee Montes. Roll Call: Trustee Tippin, no, Trustee Whitaker, no, Trustee Montes, yes, Trustee Shearer, yes, Mayor Sederwall, yes. Motion carried.

Motion for the Mayor to bring five appointees for the Water Advisory Board to the Board for approval by Trustee Tippin. Motion seconded by Trustee Whitaker. Roll Call: Trustee Tippin yes, Trustee Montes yes, Trustee Whitaker, yes. Trustee Shearer, yes. All in favor, motion carried.

Motion to take a fifteen minute break by Trustee Whitaker, seconded by Trustee Shearer. Motion carried.

Motion to return to regular session by Trustee Whitaker, seconded by Trustee Shearer. Motion carried.

After discussion about a Parks and Recreation Committee, Trustee Montes made the motion to set this for a public hearing, motion seconded by Trustee Shearer. All in favor, motion carried.

Updates on all committees, projects and CCNG were given to the public.

Bonita Water Pipeline: Trustee Tippin brought a contract for the Bonita Water Users with certain changes he had made. There was a Motion by Trustee Shearer to authorize the mayor to negotiate under the terms of this contract. The motion died for lack of a second.

The next motion was by Trustee Shearer to allow the mayor to negotiate and bring back options for continuation of water services and negotiate with Alamogordo for an extension of time. Motion seconded by Trustee Tippin. Roll call: Trustee Tippin, yes, Trustee Whitaker, yes, Trustee Montes, yes, Trustee Shearer, yes. All in favor, motion carried.

Motion to adjourn by Trustee Shearer, seconded by Trustee Whitaker. All in favor, motion carried.
