Re-plats of K. Bella Properties
December 29, 2009

The Village of Capitan held a public hearing to take comments on the re-plats of properties owned by K. Bella Properties on Tuesday, December 29, 2009 at Village Hall at 5:00 PM.  The properties being discussed are: 
Lots 7, 8, and 9, Block 77, Original Plat of Capitan Townsite
                           Lots 20, 21, 22, and 23, Block 83, Original Plat of Capitan Townsite

Mayor Hammons opened the public hearing for discussion at 5:00 PM.  Kathy Casper, owner of K. Bella Properties, explained what she would like to do.  She stated she is selling the mobiles and would like to move the lot lines so each mobile will have its own piece of property.  The mobiles are not sitting on individual lots.  They are staggered on the lots.  The lots are 25 foot lots.

Trustee Riska asked if the mobiles could be moved.  Ms. Casper stated that could not be done.  The cost would be prohibitive. She said when the mobiles were set up, they looked at putting each mobile on a single lot and there would not be any room between each one.  The way they are placed, each one has some space and room to have small yards and some privacy.

Kay Strickland read an email that Delia Mangus sent to the Village regarding the proposed lot lines.  She felt by re-plating the property it would de-value her land, which is next to the lots on Fourth Street.  Ms. Mangus asked that the Mayor and Trustees not approve the request.  Ms. Casper said she worked very closely with the Village when she moved the mobiles in.  She said she is very concerned about how Capitan looks because Capitan is her home.

Trustee Riska stated the planning board met on 10-6-09 and considered Ms. Casper’s request.  She read the minutes of that meeting.  The Board approved the request upon approval of the board of trustees and the village lawyer.  Mayor Hammons stated the lawyer had no problem with it.

A discussion followed regarding the hazards of having 25 foot lots within the “core” of the Village.

The public hearing closed at 5:22 PM.
