A  RESOLUTION  OF  THE  VILLAGE OF CAPITAN VILLAGE TRUSTEES OF  CAPITAN,  NEW  MEXICO,  AUTHORIZING  THE SUBMISSION  OF  A  COLONIAS INFRASTRUCTURE APPLICATION  TO  THE  NEW MEXICO FINANCE AUTHORITY;  AND  AUTHORIZING  THE  MAYOR  TO  ACT  AS  THE  CITY’S  CHIEF  EXECUTIVE  OFFICER  AND  AUTHORIZED  REPRESENTATIVE  IN  ALL  MATTERS  PERTAINING  TO  THE  VILLAGE’S PARTICIPATION  IN  COLONIAS INFRASTRUCTURE PROCESS.


    WHEREAS, the Village of Capitan is a designated colonia; and has a lack of an adequate sewage system; water system; or safe and sanitary housing; and

    WHEREAS,      the Village of Capitan has held a public hearing for public input and comment during the 2012 application process; and

    WHEREAS,   the Council finds that there is a significant need to undertake the water system improvements to provide adequate services to the community; and

    WHEREAS,       The Council determines that the water system improvements meet the requirements of the Colonias Infrastructure Act (SB279)

    NOW, THEREFORE BE IT RESOLVED BY THE GOVERNING BODY OF THE VILLAGE OF CAPITAN, NEW MEXICO, that

1.  The  Village is hereby authorized to prepare and submit a Colonias Infrastructure  application to the New Mexico Finance Authority for  water system improvements; and

2.  That the Village directs and designates Mayor Sam Hammons as the Village’s Chief Executive Officer and Authorized Representative to act in all matters in connection with this application and the Village’s participation in the Colonias Infrastructure  Program.

3.  The Village’s   officials and staff are directed to do any and all acts necessary to carry out the intent of this Resolution.

4.  That it further be stated that the Village of Capitan is committing a 10% cash match  (which may be from prior funding for the same project) and 10% loan component (negotiable term and 0% interest) from its Water Fund as a contribution toward the design and construction activities of water system improvements
