WHEREAS, the Village of Capitan is authorized to declare the property owned by David Clowe as being unsafe; and

WHEREAS, the property located in the 600 Block of Mt. Capitan Road is over grown with weeds, tall grass and dead trees and is a menace to the pubic comfort, health, peace or safety; and

WHEREAS, the Village of Capitan requires the owner to remove the weeds, tall grass and dead trees from said address.  If the owner does not begin the removal within ten (10) days of the receipt of this notice, or file a written objection with the Village Clerk, the Village of Capitan may remove the debris at the expense of the owner and place a lien on the property for the cost of the removal.

NOW THEREFORE BE IT RESOLVED that the Governing Body of the Village of Capitan meeting in regular session on the 8th day of April 2008, does approve of declaring the property unsafe and demand the removal of the weeds, tall grass and dead trees.

DONE, PASSED, AND APPROVED this 8th day of April 2008 by the Governing Body of the Village of Capitan, New Mexico.
