AN ORDINANCE AMENDING TITLE 9 – UTILITIES
CHAPTER 3 – SEWER SYSTEM REGULATIONS, SECTION 5 – SERVICE FEES

BE IT ORDAINED BY THE GOVERNING BODY OF THE VILLAGE OF CAPITAN OF CAPITAN, NEW MEXICO.
SECTION 1. ADOPTION BY REFERENCE
Amending Title 9 (Utilities), Chapter 3 (Sewer System Regulations), Section 5 (Service Fees) of the Village Code to read:
9-3-5: SERVICE FEES: The village shall charge and collect from all users of sewer lines and the sewage system, a monthly service charge as hereby set forth:

A.    Single-Family Dwellings: For all single-family dwellings, the charge shall be fifteen dollars ($15.00) excluding New Mexico gross receipts taxes.
B.    Duplexes, Apartments: For all other dwelling, including duplexes, apartments, rooming houses, trailer courts, and any other multiple-family dwellings, the charge shall be fifteen dollars ($15.00) per each occupied unit or space, excluding New Mexico gross receipts taxes.
C.    Commercial Establishments, Industries: For all commercial establishments, schools and districts, the charge shall be seventeen dollars ($17.00), plus ten percent (10%) of that month’s water charge, excluding New Mexico gross receipts taxes.
D.    Users Outside Village: All users outside the village limits shall be charged and there shall be assessed an amount three (3) times greater than the charge of the category in which they would be charged if they were located within the village. SECTION 2. EFFECTIVE DATE
This ordinance shall take effect on the 1st day of March 2011.
