AN ORDINANCE AMENDING TITLE 11 – SUBDIVISION REGULATIONS
CHAPTER 1 – GENERAL PROVISIONS
SECTION 9 – CONSIDERATIONS FOR SUBDIVISION PLATTING; ITEM 5A
BE IT ORDAINED BY THE GOVERNING BODY OF THE VILLAGE OF CAPITAN OF
CAPITAN, NEW MEXICO.
SECTION 1. ADOPTION BY REFERENCE
Amending Title 11 (Subdivision Regulation), Chapter 1 (General
Provisions), Section 9-5A (Considerations for Subdivision Platting)
of the Village Code to read:
11-1-9 as is: The village will take into consideration the
following conditions when reviewing plats for approval:
5A. Lots in any subdivision or replat shall be no less than
three (3) acres. Replat that do
not increase the total number of lots may have lots smaller than
three (3) acres.
11-1-9 as proposed:
5A. Lots in any subdivision or replat that have access to
village sewer and water shall be no less than
½ acre minimum. Any lot that does not have access to
village sewer and water shall be a minimum of two acres. The
developer will provide the infrastructure.
SECTION 2. EFFECTIVE DATE
This ordinance shall take effect on the 29th day of August 2011.
