ORDINANCE 2007 - ____

AN ORDINANCE CONSENTING TO LANDOWNERS PETITIONS FOR ANNEXATION INTO THE VILLAGE OF CAPITAN, NEW MEXICO, CERTAIN CONTIGUOUS LANDS AS SHOWN BY MAPS THEREOF, ATTACHED TO THIS ORDINANCE AND REFERRED TO AS EXHIBIT “A”, SAID PROPERTY BEING ANNEXED HEREINAFTER MORE PARTICULARLY DESCRIBED.

WHEREAS, on the 13th day of February, 2007, petitions were presented to the Village of Capitan, New Mexico by the following owners:

    1. Bartley K. McDonough, owner of: Section 09 Township 09S Range 14E, A tract of land situate within Section being a portion of Tract A, Mohaco SD -              Unit I, as described in deed in Book 104, Page 651

    2. Tom and Denise Snyder, owner of: Tract 139 Mesa Verde Acres, Unit 4

    3. Benny L. Taylor, owner of: Mesa Verde Acres SD. Unit III Tract 78 containing 8.45 acres.

for annexation of said property into the Village limits of the Village of Capitan; and

WHEREAS, it appearing that said tracts are contiguous to the present Village limits; and

WHEREAS, said Petition appears regular in every respect, and said annexation appearing to be in the best interests of the Village of Capitan, New Mexico,

BE IT ORDAINED by the Governing Body of the Village of Capitan, New Mexico that said Governing Body consents to said annexation.

APPROVED AND PASSED this 13th day of February 2007.
